Residential Tenancies

The formalities for renting property have been simplified in recent years. Most residential property in the private rented sector will be let as an Assured Shorthold Tenancy.

The important thing is to ensure that the contractual relationship between the parties is clearly set out to avoid misunderstandings. It is also important to make sure that any requirements that exist in the Title Deeds of the Property or any mortgage are met. Renting property also imposes certain statutory duties and responsibilities on both Landlord and Tenant.

Thankfully most tenancies result in harmonious relationships, but if things do go wrong it is important to have a well drawn up tenancy agreement to refer to, and to have expert advice available to guide you through difficulties, or if necessary, to take or defend proceedings.

Any deposit that is taken as security for the tenancy must now be covered by one of the Tenancy Deposit Schemes. These provide protection for the Tenant and impose registration obligations on Landlords. Failure to comply carries legal and financial consequences for a Landlord.
